For the sake of convenience we choose the masculine gender, but where \u201che\u201d is mentioned we also mean \u201cshe\u201d.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c8adb96 eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"c8adb96\" data-element_type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 1.<\/span> <span class=\"eael-dch-title-text\">Definitions<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol><li>In these Terms and Conditions, capitalized terms shall be defined as follows:<\/li><\/ol><ul><li><strong>Terms and Conditions <br \/><\/strong>the terms and conditions listed in this document as used by MH&amp;DL;<\/li><li><strong>Service<\/strong> <br \/>a service offered on the Website by MH&amp;DL;<\/li><li><strong>Login Credentials <br \/><\/strong>the combination of the Customer\u2019s username and password for placing an order on the Website;<\/li><li><strong>Customer<\/strong> <br \/>the natural person or legal entity who places an order on the Website;<\/li><li><strong>MH&amp;DL <br \/><\/strong>the private company with limited liability MH&amp;DL, established and having an office at (1016HM) Amsterdam at Prinsengracht 417-E;<\/li><li><strong>Agreement<\/strong> <br \/>the agreement between the Customer and MH&amp;DL, which is concluded via the Website on the basis of which the Customer buys the Product and \/ or the Service from MH&amp;DL;<\/li><li><strong>Product<\/strong> <br \/>a product that is offered on the Website by MH&amp;DL;<\/li><li><strong>Privacy Statement<\/strong> <br \/>the Privacy Statement of MH&amp;DL, which can be found on the Website;<\/li><li><strong>Website <br \/><\/strong>the website owned by MH&amp;DL, on which the Product and \/ or the Service is offered;<\/li><\/ul><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0b485e2 eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"0b485e2\" data-element_type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 2.<\/span> <span class=\"eael-dch-title-text\">Applicability<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol>\n<li>These Terms and Conditions apply to every offering made by MH&amp;DL on the Website, to every Agreement concluded via the Website and to every use of the Website.<\/li>\n<li>MH&amp;DL may amend and \/ or complement these Terms and Conditions at any time. Changes do not apply to already concluded Agreements. The most up to date version of the Terms and Conditions can be found on the Website. If the Customer does not agree with the amended and \/ or complemented Terms and Conditions, the Customer cannot order the Product and \/ or the Service.<\/li>\n<li>The applicability of any of the Customer\u2019s purchasing terms and conditions or other conditions is expressly rejected by MH&amp;DL.<\/li>\n<\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-145511a eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"145511a\" data-element_type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 3.<\/span> <span class=\"eael-dch-title-text\">Offer and establishment of the Agreement<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol>\n<li>The Agreement enters into force by completing the ordering process on the Website and accepting the Terms and Conditions.<\/li>\n<li>An offer on the Website is always without any obligation and can be revoked by MH&amp;DL immediately after an order.<\/li>\n<li>MH&amp;DL is not bound by apparent errors and clerical errors in the offer on the Website.<\/li>\n<\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b7cc6f5 eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"b7cc6f5\" data-element_type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 4.<\/span> <span class=\"eael-dch-title-text\">Use and Availability of the Website<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol>\n<li>MH&amp;DL does not guarantee that information on the Website is always correct, current or complete.<\/li>\n<li>During the registration process, the Customer can be asked to provide Login Credentials. The Customer guarantees to MH&amp;DL, and is responsible for ensuring that the information he provides is correct, complete and current.<\/li>\n<li>The Customer is responsible and liable for all use made with his Login Credentials.<\/li>\n<li>As soon as the Customer knows or has reason to suspect that his Login Credentials came into the hands of unauthorized persons, the Customer is obliged to report this case to MH&amp;DL, without prejudice to the obligation to immediately take effective measures himself, such as changing the Login Credentials.<\/li>\n<li>MH&amp;DL reserves the right to change the login procedure and \/ or Customer\u2019s Login Credentials if it is deemed to be necessary for the functioning of the Website.<\/li>\n<\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0efb9d5 eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"0efb9d5\" data-element_type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 5.<\/span> <span class=\"eael-dch-title-text\">Price and payment<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol><li>The stated price of the Product and \/ or the Service is valid the moment it is displayed on the Website. VAT is excluded in the stated total price. Any additional costs, such as shipping and payment costs, will be mentioned on the Website.<\/li><li>The payment methods will be mentioned on the Website When the Customer chooses a method of payment after delivery, the payment term depends on the payment method chosen, as indicated on the Website. The payment term is a deadline.<\/li><li>If the Customer exceeds the payment deadline or MH&amp;DL is unable to collect the amount due by means of the payment instrument chosen by the Customer before the end of the payment term, the Customer shall legally be in default, regardless of whether MH&amp;DL sends any further warning or notice.<\/li><li>If the Customer is in default with regard to his payment obligation, MH&amp;DL may refer the debt for collection, in which case the Customer shall also be obliged to pay the costs incurred by MH&amp;DL in accordance with the graduated scale of judicial collection expenses (BIK).<\/li><\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cad364e eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"cad364e\" data-element_type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 6.<\/span> <span class=\"eael-dch-title-text\">Delivery<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol>\n<li>The delivery deadlines on the Website and \/ or during the ordering process are indicative and cannot be considered legal deadlines.<\/li>\n<\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-21c0a9c eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"21c0a9c\" data-element_type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 7.<\/span> <span class=\"eael-dch-title-text\">Privacy<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol>\n<li>When visiting the Website and placing an order, or indicating Login information, (personal) information is supplied to MH&amp;DL. This (personal) information shall be processed in accordance with the applicable laws and regulations and the Privacy Statement.<\/li>\n<\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-85b4bed eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"85b4bed\" data-element_type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 8.<\/span> <span class=\"eael-dch-title-text\">Withdrawal and complaints<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol>\n<li>Within 14 days after the receipt of the Product and \/ or after start of delivery of the service the Customer has the right to dissolve the Agreement without providing reasons, unless one of the exceptions in Article 6:230p of the Dutch Civil Code applies. If the right of dissolution applies, then the Customer can invoke this right by filling in the model form for dissolution, as provided by MH&amp;DL, and by returning this form \u2013 together with the Products delivered but not desired by the Customer \u2013 to MH&amp;DL. The costs of return shipment are at the expense of the Customer.<\/li>\n<li>In the event of dissolution of the Agreement, the Customer is obliged to return the Product delivered but not desired by the Customer as quickly as possible, and in any case within 14 days after the declaration of dissolution.<\/li>\n<li>In the event of dissolution of the Agreement, MH&amp;DL will refund the already paid amount under the Agreement by the Customer within 14 days after receipt of the declaration of dissolution. MH&amp;DL is entitled to deduct the value reduction of the Product from the amounts to be refunded, insofar as this decrease in value is the result of use by the Customer that goes beyond what is necessary to determine the nature, characteristics and functioning of the Product.<\/li>\n<li>If the Customer has opted for a different method of shipment than the standard shipping method, only the costs for the standard shipping will be reimbursed by MH&amp;DL.<\/li>\n<li>Complaints about the Product and \/ or the Service can be sent to <a href=\"mailto:info@mhwines.local\">info@mhwines.local<\/a>. MH&amp;DL will react substantively to the complaint within a reasonable period of time.<\/li>\n<\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-651f658 eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"651f658\" data-element_type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 9.<\/span> <span class=\"eael-dch-title-text\">Conformity<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol>\n<li>If a Product does not comply with the Agreement, MH&amp;DL will repair the Product free of charge and within a reasonable time period at the discretion of MH&amp;DL or, in case of absence of a Product or parts thereof, still deliver them. If the repair is not possible or can\u2019t be demanded of MH&amp;DL, MH&amp;DL will replace the Product.<\/li>\n<li>If MH&amp;DL has not repaired the Product within a reasonable period, the Customer is entitled to address another party for recovery. MH&amp;DL will reimburse the reasonable costs invoiced by this third party with regard to the recovery.<\/li>\n<li>An appeal to the Product\u2019s non-compliance with the Agreement is not possible if it was already known or could reasonably have been known to the Customer upon the conclusion of the Agreement that there was a defect, or if the nature of the purchased Product or the nature of the defect is contrary to this.<\/li>\n<\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2fbe659 eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"2fbe659\" data-element_type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 10.<\/span> <span class=\"eael-dch-title-text\">Liability<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol>\n<li>MH&amp;DL does not accept any liability for indirect or consequential damages, such as loss of profit, loss of turnover, loss of expected savings and other similar financial losses, as well as loss of goodwill or damage to reputation.<\/li>\n<li>To the extent that MH&amp;DL is liable, this liability is limited to a maximum of the price of the Product and \/ or the Service.<\/li>\n<\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-418c161 eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"418c161\" data-element_type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 11.<\/span> <span class=\"eael-dch-title-text\">Miscellaneous<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol>\n<li>The Customer may not transfer the rights and obligations arising from the Agreement to third parties.<\/li>\n<li>The use of the Website, these Terms and Conditions and \/ or the Agreement are subject solely to Dutch law.<\/li>\n<\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Terms and conditions of MH&#038;DL We kindly advise you to read these Terms and Conditions carefully so you are aware of your rights and obligations under this Agreement.
