You are referred to in these Terms and Conditions as the Customer. style=\"vertical-align: inherit\">Terms and Conditions<\/span><\/span><\/span><\/span><br \/><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> the terms and conditions listed in this document as used by MH Wines;<\/span><\/span><\/span><\/span><\/li><li><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Service<\/span><\/span><\/span><\/span><\/strong> <br \/><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> a service offered on the Website by MH Wines;<\/span><\/span><\/span><\/span><\/li><li><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Login Credentials<\/span><\/span><\/span><\/span><br \/><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> the combination of the Customer&#8217;s username and password for placing an order on the Website;<\/span><\/span><\/span><\/span><\/li><li><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Customer<\/span><\/span><\/span><\/span><\/strong> <br \/><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> the natural person or legal entity who places an order on the Website;<\/span><\/span><\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">MH Wines <\/span><\/span><br \/><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">the private company with limited liability MH Wines, established and having an office at (1016HM) Amsterdam at Prinsengracht 417-E;<\/span><\/span><\/span><\/span><\/li><li><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Agreement<\/span><\/span><\/span><\/span><\/strong> <br \/><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> the agreement between the Customer and MH Wines, which is concluded via the Website on the basis of which the Customer buys the Product and \/ or the Service from MH Wines;<\/span><\/span><\/span><\/span><\/li><li><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Product<\/span><\/span><\/span><\/span><\/strong> <br \/><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> a product that is offered on the Website by MH Wines;<\/span><\/span><\/span><\/span><\/li><li><strong><span style=\"vertical-align: inherit\"> the Privacy Statement of MH Wines, which can be found on the Website;<\/span><\/span><\/span><\/span><\/li><li><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Website<\/span><\/span><\/span><\/span><br \/><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> the website owned by MH Wines, on which the Product and\/or the Service is offered;<\/span><\/span><\/span><\/span><\/li><\/ul><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0b485e2 eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"0b485e2\" data-element_type=\"widget\" class=\"eael-dch-title-text\">Applicability<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">These Terms and Conditions apply to every offering made by MH Wines on the Website, to every Agreement concluded via the Website and to every use of the Website.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">MH Wines may amend and\/or complement these Terms and Conditions at any time. Changes do not apply to already concluded Agreements. The most up to date version of the Terms and Conditions can be found on the Website. If the Customer does not agree with the amended and\/or supplemented Terms and Conditions, the Customer cannot order the Product and\/or the Service.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">The applicability of any of the Customer&#8217;s purchasing terms and conditions or other conditions is expressly rejected by MH Wines.<\/span><\/span><\/li><\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-145511a eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"145511a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 3.<\/span> <span class=\"eael-dch-title-text\">Offer and establishment of the Agreement<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">The Agreement enters into force by completing the ordering process on the Website and accepting the Terms and Conditions.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">An offer on the Website is always without any obligation and can be revoked by MH Wines immediately after an order.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">MH Wines is not bound by apparent errors and clerical errors in the offer on the Website.<\/span><\/span><\/li><\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b7cc6f5 eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"b7cc6f5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 4.<\/span> <span class=\"eael-dch-title-text\">Use and Availability of the Website<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">MH Wines does not guarantee that information on the Website is always correct, current or complete.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">During the registration process, the Customer can be asked to provide Login Credentials. The Customer guarantees to MH Wines, and is responsible for ensuring that the information he provides is correct, complete and current.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">The Customer is responsible and liable for all use made with his Login Credentials.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">As soon as the Customer knows or has reason to suspect that his Login Credentials came into the hands of unauthorized persons, the Customer is obliged to report this case to MH Wines, without prejudice to the obligation to immediately take effective measures himself, such as changing the Login Credentials.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">MH Wines reserves the right to change the login procedure and\/or Customer&#8217;s Login Credentials if it is deemed to be necessary for the functioning of the Website.<\/span><\/span><\/li><\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0efb9d5 eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"0efb9d5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 5.<\/span> <span class=\"eael-dch-title-text\">Price and payment<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">The stated price of the Product and\/or the Service is valid the moment it is displayed on the Website. VAT is excluded in the stated total price. Any additional costs, such as shipping and payment costs, will be mentioned on the Website.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">The payment methods will be mentioned on the Website When the Customer chooses a method of payment after delivery, the payment term depends on the payment method chosen, as indicated on the Website. The payment term is a deadline.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">If the Customer exceeds the payment deadline or MH Wines is unable to collect the amount due by means of the payment instrument chosen by the Customer before the end of the payment term, the Customer shall legally be in default, regardless of whether MH Wines sends any further warning or notice.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">If the Customer is in default with regard to his payment obligation, MH Wines may refer the debt for collection, in which case the Customer shall also be obliged to pay the costs incurred by MH Wines in accordance with the graduated scale of judicial collection expenses (BIK).<\/span><\/span><\/li><\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cad364e eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"cad364e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 6.<\/span> <span class=\"eael-dch-title-text\">Delivery<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol>\n<li>The delivery deadlines on the Website and \/ or during the ordering process are indicative and cannot be considered legal deadlines.<\/li>\n<\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-21c0a9c eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"21c0a9c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 7.<\/span> <span class=\"eael-dch-title-text\">Privacy<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">When visiting the Website and placing an order, or indicating Login information, (personal) information is supplied to MH Wines. This (personal) information shall be processed in accordance with the applicable laws and regulations and the Privacy Statement.<\/span><\/span><\/li><\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-85b4bed eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"85b4bed\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 8.<\/span> <span class=\"eael-dch-title-text\">Withdrawal and complaints<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Within 14 days after the receipt of the Product and \/ or after start of delivery of the service the Customer has the right to dissolve the Agreement without providing reasons, unless one of the exceptions in Article 6:230p of the Dutch Civil Code applies. If the right of dissolution applies, then the Customer can invoke this right by filling in the model form for dissolution, as provided by MH Wines, and by returning this form \u2013 together with the Products delivered but not desired by the Customer \u2013 to MH Wines. The costs of return shipment are at the expense of the Customer.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">In the event of dissolution of the Agreement, the Customer is obliged to return the Product delivered but not desired by the Customer as quickly as possible, and in any case within 14 days after the declaration of dissolution.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">In the event of dissolution of the Agreement, MH Wines will refund the amount already paid under the Agreement by the Customer within 14 days after receipt of the declaration of dissolution. MH Wines is entitled to deduct the value reduction of the Product from the amounts to be refunded, insofar as this decrease in value is the result of use by the Customer that goes beyond what is necessary to determine the nature, characteristics and functioning of the Product.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">If the Customer has opted for a different method of shipment than the standard shipping method, only the costs for the standard shipping will be reimbursed by MH Wines.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Complaints about the Product and\/or the Service can be sent to <\/span><\/span><a href=\"mailto:info@mhwines.local\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">info@mhwines.local<\/span><\/span><\/a><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> . MH Wines will respond substantively to the complaint within a reasonable period of time.<\/span><\/span><\/li><\/ol><\/span>\n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-651f658 eael-dual-header-content-align-left exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-eael-dual-color-header\" data-id=\"651f658\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"eael-dual-color-header.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"eael-dual-header\">\n\t\t\t\t<h2 class=\"title eael-dch-title\"><span class=\"eael-dch-title-text eael-dch-title-lead lead solid-color\">Article 9.<\/span> <span class=\"eael-dch-title-text\">Conformity<\/span><\/h2>\t\t\t\t\t<span class=\"subtext\"><ol><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">If a Product does not comply with the Agreement, MH Wines will repair the Product free of charge and within a reasonable time period at the discretion of MH Wines or, in case of absence of a Product or parts thereof, still deliver them. If the repair is not possible or can&#8217;t be demanded of MH Wines, MH Wines will replace the Product.<\/span><\/span><\/li><li><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">If MH Wines has not repaired the Product within a reasonable period, the Customer is entitled to address another party for recovery.
